Lucky Draw Terms and Conditions
 

The NETS FlashPay / NETS CashCard Win S$100,000 Promotion (“the Draw”) is organized by NETWORK FOR ELECTRONIC TRANSFERS (SINGAPORE) PTE LTD (“NETS”)

Eligibility

  1. Any individual (“the Participant”) who uses any NETS FlashPay CEPAS card on the MRT / LRT and/or Public Buses, ERP* and Carparks^ and /or retail outlets and NETS CashCard on ERP and Carparks shall be eligible to participate in the Draw.

    *Applicable only with the new generation In-vehicle unit
    ^Carparks that have been upgraded to accept CEPAS-compliant cards.

  2. Employees of NETS Group and that of NETS agents, contractors, sub-contractors and their immediate family members are not eligible to participate in the lucky draw.

Qualifying Period

  1. The qualifying period for the Draw is from 16 March 2011 to 31 March 2012 (both dates inclusive) (“Qualifying Period”) or such other period as may be determined by NETS in its absolute discretion.


How to participate

    Via SMS
  1. Participant will need to send an SMS in the following format to 79797:

    WIN<space>Full Name <space>NRIC No<space>16-digit CAN No.

    One time registration is required. Only one set of 16-digit CAN No. is permitted per SMS.

    Please note that Participants with Frank by OCBC Credit Card are automatically eligible to participate in the Draw and do not need to send this SMS.

  2. The 16-digit CAN No. can be found at the back of the NETS FlashPay card and NETS CashCard.



  3. All details and particulars submitted must be true, accurate and complete. Incorrect or incomplete entry for the Draw will be disqualified.

    Via Submission of Registration form
  1. Participant can also submit the registration form at specific malls / hub road show which will be included in various communication channels throughout the qualifying period.

  2. Cardholder must tick the checkbox on the registration form which indicates participant’s consent and allowing NETS through a third party to register his/her details for the NETS FlashPay/NETS CashCard Win $100,000 Promotion."

  3. If participant do not tick the checkbox, NETS will not register the participant’s details for the NETS FlashPay/NETS CashCard Win $100,000 Promotion."

  4. All registration forms collected by NETS in each qualifying period will be registered based on the SMS Registration date(s) indicated below:

How to win

  1. Subject to the terms and conditions contained herein, the number of chances you may have in the Draw shall be calculated as follows:

    Every valid CashCard transaction on ERP, Carparks and retail points 1 chance

    ^Carparks that have been upgraded to accept CEPAS-compliant cards.


  2. Lucky Draw chances are tracked based on the registered 16-digit CAN No. In the event of card lost/damage/misplaced, transfer of lucky draw chances will not be allowed.

  3. Allocation of chances shall start on the date when the cardholder registered his/her 16-digit CAN No.

Conduct of Lucky Draw & Prizes

Quarterly Draw

  1. There will be 10 winners in each Quarterly draw. The Lucky Draw will be conducted on the following dates:

  2. Each registered 16-digit CAN No. can only win one prize for each quarterly draw.

  3. The chances allocated under each qualifying period shall only be applicable for their respective quarterly draw.

Grand Draw

  1. There will be one (1) winner in the Grand draw. The Grand Draw will be conducted on this date:

  2. All chances accumulated from the date of registration until 31 March 2012 will be entitled for the Grand Draw.

  3. The prize amount will be issued in the form of a cheque made out to the winner’s name as per registration details, and NETS reserves the right to disqualify the winner if the name provided during registration does not correspond to the name stated within the NRIC/FIN. NETS accept no liability for any loss or damage of the cheque nor for its being banked in after 6 months from the date of the cheque issuance.

  4. The lucky draw will be conducted at NETS office at 298 Tiong Bahru Road, #04-01/06 Central Plaza Singapore 168730 or such other venue as may be determined by NETS and it is not open to the public. NETS reserve the right to change the draw date(s) at its sole discretion. The winning NETS FlashPay Card or NETS CashCard will be selected at random by means of a computerized system during the draw. NETS decision as to the winner of the draw shall be final and conclusive. At the draw, NETS may draw “reserve winners” to replace any winner subsequently disqualified.

  5. The winner shall be notified by phone and no other notification will be made by NETS. The winner (and any reserve winner) must be contactable within 4 attempts over 48 hours.

  6. The registered NETS FlashPay Card or NETS CashCard and NRIC must be produced to claim the prize. Any discrepancy between the SMS entry received and the documents/requirements produced for verification will be deemed as disqualified. The prize shall be claimed within 30 calendar days from the date of notification (“claim period”) at:

  7. In the event, the winning card was replaced due to faulty or damaged card, cardholder must still keep the winning card and present it upon redemption. If cardholder is unable to present the winning card, NETS will deem it as disqualified.

  8. If the prize remains unclaimed after this claim period, it shall be forfeited without the liability on the part of NETS to the winner and donated to a charity of NETS’ choice.

  9. The results of the draw will be announced on NETS website and press advertisement after the draw. NETS’ decision in this Promotion/Lucky Draw shall be final and no correspondence will be entertained.

  10. If NETS subsequently discovers or determines in its absolute discretion that a participant is not entitled to or is disqualified to participate in the lucky draw, NETS at its sole discretion do any of the following:
    a) forfeit the prize; and/or
    b) reclaim the prize from the participant and select another participant who qualifies.

General

  1. NETS, NETS’s authorized agencies, sponsors, organizations and the directors, officers, employees and assignee thereof (collectively the “Indemnified Persons”) shall not be liable in any way for any claim, loss, injury, damage or inconvenience (a) arising in connection with the Draw, including any error in computing the number of rides, any breakdown or malfunction in any computer system or equipment, any notice which is misdirected or lost in the post; or (b) suffered or incurred by a Participant, the winner or any other person howsoever arising in connection with the Draw. Each Participant in the Draw (including his or her heirs executors and/or administrators) hereby agrees to indemnify and hold each of Indemnified Persons harmless from and against any and all claim, loss or damage that may be suffered by the Participant in relation to the Draw or any prize and shall release and discharge each of the Indemnified Persons completely from any and all claims, liabilities, judgments, suits, proceedings, actions and all costs (including solicitor and client costs), expenses, penalties, fines or fees brought by or against the Participant.

  2. Neither NETS nor its authorized agencies and any sponsor or organization associated with the Draw shall be held liable for any failure or omission to carry out the Draw in accordance with these terms and conditions or for any loss or damage suffered by the Participants if such failure, omission, loss or damage arises out of or in connection with any event of force majeure, including without limitation any calamity or conditions, acts of God or warlike hostilities, civil commotion, riots, blockades, embargoes, sabotages, strikes, fires, lockouts, shortages of material or labour, terrorist activity, epidemic, health risk or any defect, failure, interruption, breakdown or malfunction of any machine, computer system, data processing system or transmission link, or any other occurrence beyond the reasonable control of NETS, its authorized agencies and any sponsor or organization associated with the Draw, as the case may be.

  3. NETS's decision on all matters relating to or in connection with the Promotion/Lucky Draw shall be at its sole and absolute discretion and shall be final and binding on all Participants. Except for the notification to the winners, NETS shall not be obliged to enter into any correspondence on any matter concerning the Draw. In the event of any inconsistency between these Terms & Conditions and any brochure, marketing or Lucky Draw material relating to the Lucky Draw, these Terms & Conditions shall prevail.

  4. Prizes are not transferable or exchangeable for cash, credit or any other items. NETS may at its sole discretion at any time and without prior notice replace or substitute a prize with another prize of similar value selected by NETS. NETS makes no representations or warranties as to the quality/suitability/fitness for purpose/merchantability of any of the goods/services offered as prizes. NETS is not liable for any loss, damage or injury suffered or sustained, to person or property and including, but not limited to, indirect and consequential (including economic) losses by reason of the use, enjoyment or operation of any prize by a Participant, his family or any other person.

  5. NETS shall not be liable in any way for any loss or damage arising in connection with the Promotion/Lucky Draw, including but not limited to problems or any breakdown or malfunction of any computer system or equipment, software, any telephone network or lines, servers or providers or any combination thereof.

  6. If for any reason the Promotion/Lucky Draw is not capable of running as planned (including and not limited to) infection by computer virus, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of NETS which corrupt or affect the administration, operation, security, fairness, integrity or proper conduct of the Draw, NETS reserve the right in its sole discretion to disqualify any Participant who tampers with the entry process and to cancel, terminate, modify or suspend the Promotion/Lucky Draw.

  7. By participating in the Promotion/Lucky Draw, the Participants shall be automatically granted an immediate NETS Membership and shall enjoy the privileges accorded to a NETS member. Participants shall be deemed to have read, understood and agreed to be bound by the Terms and Conditions Governing NETS Membership, copies of which are available at www.nets.com.sg.

  8. By providing their personal particulars in the Promotion/Lucky Draw, the Participants shall be deemed to have agreed to the use, publication and disclosure by NETS of their personal particulars (including their names, identification/passport numbers and photographs) in connection with their participation in the Draw and the NETS Membership, without additional compensation.

  9. NETS reserve the right to disclose and publish the name, and such other particulars (including the photograph) of any Participant/winner in such mode and manner as NETS may in its sole discretion deem appropriate for publicity purposes and the winner agrees to be photographed, the disclosure of his or her personal particulars, the use of his or her name, picture, image and voice for publicity purposes connected with the Promotion/Lucky Draw and to co-operate with and participate in the activities organized by NETS for this purpose without additional compensation.

  10. NETS reserve the right at its absolute discretion to terminate the Promotion/Lucky Draw or vary, delete, add to any of these Terms and Conditions from time to time without prior notice including without limitation the date of the Promotion/Lucky Draw.

  11. These Terms and Conditions shall be governed by the laws of Singapore and the Participants irrevocably submit to the non-exclusive jurisdiction of the Courts of Singapore.

  12. A person who is not a party to any agreement governed by these Terms and Conditions shall have no rights under the Contracts (Rights of Third Parties) Act (Cap 53) to enforce any provision of these Terms and Conditions.

  13. Submission of the entry by a Participant signifies his or her acceptance of the Terms and Conditions stated above.
